Terms & Conditions
These terms explain how you may use our website and the terms on which we sell products through our online shop. Please read them before placing an order and keep a copy for your records.

2. These terms
These terms apply to purchases from our online shop by consumers buying mainly for personal use. Please contact us before ordering if you are buying for a business.
Product descriptions, delivery information and any specific terms clearly provided before you order also form part of your purchase agreement. Nothing in these terms removes information or promises that the law treats as binding.
The version in force when you place your order applies to that order. Later updates do not retrospectively change an existing contract.
3. Placing and accepting an order
You must be at least 18 to place an order. If you are under 18, a parent or guardian should place the order on your behalf.
Please check your products, quantities, delivery address and contact information carefully before submitting your order. Contact us promptly if you notice an error. We will try to help, although changes may not be possible once an order has been dispatched or production has begun.
Placing an order is an offer to buy the selected products. An automated acknowledgement confirms that we have received your order; it does not by itself mean that we have accepted it. We accept your order when we send a dispatch confirmation, or when we expressly confirm acceptance in writing, including for a made-to-order purchase.
If we cannot accept your order, for example because an item is unavailable or payment cannot be authorised, we will let you know and refund any payment taken for the affected items.
If we identify a pricing or description error before accepting your order, we will explain it and give you the choice of proceeding on the corrected basis or cancelling for a refund. We will not substitute products without your agreement. Once a contract has been formed, we will not change its price or material terms without your agreement or a lawful basis.
4. Product information
We take reasonable care to describe and photograph our products accurately. Colours may appear differently on different screens, and natural materials may vary in grain, texture or shade. These variations do not remove your right to receive goods that match their description.
Please check the dimensions, materials, care instructions and other product details before ordering. For furniture, consider the space available and the access route into your home. Contact us if you need clarification.
Where a product has options such as fabric, colour or size, please check your selection carefully. Any agreed specifications will be recorded as part of your order.
5. Prices and payment
Prices are displayed in pounds sterling and include applicable UK VAT. Delivery charges and any other applicable charges will be shown before you complete your purchase.
Payment methods available for your order are shown at checkout. Payment must be authorised before we process your purchase. Any separate payment schedule for a made-to-order item will be agreed before the order is accepted.
If you choose a third-party payment or finance service, its eligibility requirements and payment terms also apply. Those arrangements do not replace your consumer rights against us.
6. Delivery, risk and ownership
Available delivery services, charges and timings are provided before you order. Please also read our Delivery Information page. Any different lead time for furniture, pre-orders or made-to-order items will be explained before purchase.
We will deliver within the agreed timeframe. Unless we have agreed a different period with you, delivery will take place without undue delay and within 30 days of the contract being made.
If delivery is delayed, we will contact you and explain the options available. Your legal rights to require delivery within an appropriate additional period, or to cancel where the law allows, remain unaffected.
The goods remain our responsibility until you, or a person you nominate to receive them, takes physical possession. A different legal rule may apply if you independently arrange a carrier that we have not offered.
Ownership passes to you once we have received payment in full. Please tell us promptly if your parcel is missing, damaged or contains the wrong items.
7. Your right to cancel an online order
For most online purchases, you may cancel without giving a reason. You can tell us before delivery or within 14 days beginning the day after you receive the goods. If goods from one order are delivered separately, the period generally begins the day after the last item is received.
To cancel, send a clear statement to barn@baileyswistow.co.uk or write to our shop address. Include your name, order number and the items you wish to cancel. You may use the optional form below, but you do not have to.
It is enough to send your cancellation notice before the cancellation period expires. You do not need to wait for our approval to exercise your legal right to cancel.
After notifying us, you must send the goods back without undue delay and no later than a further 14 days.
8. Personalised and made-to-order goods
The statutory change-of-mind cancellation right does not apply to goods made to your specifications or clearly personalised where the legal exception applies. We will explain any applicable exception before you place your order.
An item is not automatically exempt simply because it is described as “made to order”. Choosing from standard product options does not, by itself, necessarily remove your cancellation rights.
If you wish to cancel an order that is legally exempt, contact us as soon as possible. We will explain whether cancellation can be agreed and any reasonable charge for losses we cannot avoid, taking account of costs saved. Any such charge must be lawful and fair.
Your rights if goods are faulty, damaged or not as described still apply to personalised and made-to-order products.
9. Returning items
Please contact us for return instructions and package the goods securely. Where possible, include the original packaging, labels, accessories and instructions. We recommend tracked delivery and retaining proof of postage.
You may inspect goods as you reasonably would in a shop. Where permitted by law, we may reduce a refund to reflect a loss in value caused by handling beyond what is necessary to establish the goods’ nature, characteristics and function. Opening packaging does not automatically remove your cancellation right.
You pay the direct cost of a change-of-mind return where we informed you of this before purchase. For goods that cannot normally be returned by post, any applicable return cost or reasonable estimate will be disclosed before ordering. Different arrangements apply to faulty or incorrect goods.

10. Refunds and exchanges
For a valid statutory cancellation, we will refund without undue delay and within 14 days of receiving the goods back or receiving evidence that you have sent them back, whichever happens first. If we have agreed to collect the goods, or no goods were supplied, the applicable deadline is 14 days after you notify us of cancellation.
When you cancel the whole order, we will also refund the original delivery charge up to the cost of the least expensive standard delivery service we offered. Any additional amount paid for an upgraded service does not have to be refunded.
Refunds will use the original payment method unless you expressly agree otherwise. We do not charge a refund processing fee.
We do not offer direct exchanges for change-of-mind returns. You may return an eligible item for a refund and place a new order. This does not affect any right to a replacement for faulty or incorrect goods.
11. Faulty, damaged or incorrect goods
Goods must be of satisfactory quality, fit for their particular purpose where required by law, and as described. If something is wrong, contact us with your order number and details of the problem. Photographs can help where appropriate, but do not replace your legal rights.
You normally have a short-term right to reject non-conforming goods within 30 days of delivery. After this, you may be entitled to a repair or replacement and, in the circumstances provided by law, a price reduction or refund. Your rights do not simply end after 30 days.
We will cover reasonable return costs where goods are faulty, damaged or incorrect. Please contact us so we can arrange an appropriate return or collection.
Please retain packaging if practical, but original packaging is not a condition of exercising rights relating to faulty goods. Any manufacturer’s guarantee is additional to your rights against us.
12. Discount codes, promotions and free gifts
Promotions may have eligibility requirements, expiry dates, minimum spends or product exclusions. These will be stated with the offer or made clear before you order.
Codes must be entered at checkout where required. Combining offers is permitted only where the relevant promotion allows it.
We may change or withdraw offers for future orders. We will not retrospectively remove an agreed discount from an accepted order.
Promotional gifts have no cash alternative unless the offer says otherwise. Any requirement to return a gift when cancelling a qualifying purchase will be explained in the offer terms and will not restrict statutory rights.
13. Website use and personal information
You must not misuse our website, interfere with its operation, attempt unauthorised access or submit unlawful material. Please keep any account credentials secure and contact us if you suspect unauthorised use.
Website text, images, branding and other content belong to us or our licensors unless stated otherwise. You may use the website for personal shopping and reference, but may not reproduce its content commercially without permission or another lawful basis.
Our online shop is hosted on Shopify. Our Privacy Policy explains how personal information is collected, used and shared. Cookie choices are separate from acceptance of these purchase terms.
14. Our responsibility and events beyond our control
We are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care and skill. Loss is foreseeable if it was an obvious consequence or was reasonably contemplated when the contract was made.
Nothing excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited.
If events beyond our reasonable control affect an order, we will contact you as soon as reasonably possible and take reasonable steps to reduce the impact. These events do not remove your legal rights concerning delivery, cancellation or refunds.
15. General terms
If part of these terms is found to be unlawful or unenforceable, the remaining provisions continue to apply where legally possible.
A delay in enforcing a right does not mean that the right has been waived.
These terms are governed by the law of England and Wales. If you live elsewhere, you retain any mandatory consumer protections that apply in your country of residence. Nothing here prevents you bringing proceedings in a court available to you under applicable consumer law.
16. Contact and complaints
If you have a question or complaint, please contact us with your order number and a description of the issue. We will investigate and aim to resolve it fairly.
